AVISA Donor Protection Refund Policy

We deeply value the generosity of our donors and are committed to ensuring your donations are used as intended and with full transparency. This policy outlines your rights as a donor, refund conditions, and AVISA’s responsibilities.
1. Donations Are Voluntary
- All donations made through AVISA are voluntary contributions toward causes hosted on our platform.
- Once made, donations generally cannot be canceled or refunded except in specific situations described below.
2. Use of Donations
- Donations are directed to the fundraiser as described on the campaign page.
- AVISA does not control how the fundraiser uses the funds after withdrawal but verifies partner organizations to enhance trust.
3. Refund Conditions
Donors may request a refund if:
- There is evidence of fraud, misrepresentation, or misuse of funds.
- The fundraiser is canceled before funds are disbursed.
- AVISA identifies a violation of fundraising guidelines affecting your donation.
4. Refund Process
- Refunds are processed through the original payment method when possible.
- Processing times may vary depending on payment providers.
- AVISA reserves the right to investigate refund requests thoroughly to prevent abuse.
5. Donation Receipts
- Donors receive a receipt confirming their donation immediately via email or in-app notification.
- Receipts can be used for personal recordkeeping or tax purposes where applicable.
6. Donor Communication
- Donors may receive updates from fundraisers about campaign progress.
- AVISA may also send communications about new campaigns, platform updates, or promotions, which donors can opt out of.
7. Donor Responsibilities
- Provide accurate payment information.
- Report any suspicious campaigns or misuse promptly via the app’s reporting tools.
8. Limitation of Liability
- AVISA is not responsible for disputes between donors and fundraisers after funds have been disbursed.
- While we strive to verify campaigns, AVISA cannot guarantee the outcome or impact of any fundraiser.
AVISA Giving Guarantee Policy
We are committed to ensuring that your generosity has the impact you intended. We work diligently to protect donors, ensure transparency, and build trust between our global community and verified causes across Africa. This AVISA Giving Guarantee outlines the conditions under which donors may be eligible for a refund and the steps required to submit a claim.
1. Introduction
In the rare case of misuse or abuse, the AVISA Giving Guarantee (the “Giving Guarantee” or this “Policy”) protects our donors. This Policy applies to donations made on or after the Effective Date.*
2. For Donors
Donors can request a refund of donations made online via the AVISA platform (“Platform”) to a fundraiser. AVISA will determine, in its sole and absolute discretion, if misuse or abuse has occurred.
3. Exclusions
The following situations are excluded under this Policy:
- Requesting a refund more than one (1) year after the donation is made;
- Seeking a refund for donations not made on the Platform;
- Seeking a refund for donations made through a donor-advised fund (DAF) (including the PayPal Giving Fund);
- Seeking a refund for your donation to your own fundraiser;
- Seeking a refund for your donation that was already charged back and refunded;
- Filing abusive claims, including excessive (more than three times in one month) or duplicate claims.
4. Submitting a Claim
To make a claim under this Policy, you must meet each of the following criteria:
- You still own the payment instrument you used to make the donation at issue and are authorized to accept a funds transfer back onto that payment instrument;
- You did not in any way cause, contribute to, participate in, or induce the misuse or abuse, whether directly or indirectly;
- You fully completed the claim form below and complied with all subsequent requests for information for our evaluation and processing of your claim.
- Fully cooperate with any investigation by AVISA, our partners, or law enforcement authorities;
- Promptly notify AVISA if you receive any communication or funds from the fundraiser organizer or beneficiary.
5. No Assignment or Insurance or Warranty
This Policy is not intended to constitute an offer to insure, does not constitute insurance or an insurance contract, does not take the place of insurance obtained or obtainable by you, and you have not paid any premium in respect of the Policy. The benefits provided under this Policy are not assignable or transferable by you. This Policy is not a warranty against fraud or any other misuse of the Platform.
6. Modification or Termination
AVISA reserves the right to modify or terminate this Policy, at any time, in its sole and absolute discretion, and without prior notice. If we modify this Policy, we will post the modification on the AVISA website or provide you with notice of the modification and we will continue to process all claims made prior to the effective date of the modification.
7. Entire Agreement and Definitions
This Policy constitutes the entire and exclusive understanding and agreement between AVISA and you regarding the subject matter herein and supersedes and replaces any and all prior oral or written understandings or agreements between AVISA and you regarding your ability to claim or qualify for a refund from AVISA.
* The effective date applicable to your donation is the one communicated on the AVISA platform at the time of your gift.
